PokeBank Coverage

Pokemon Bank was available for a brief moment of time in Japan and after finding out that pokemon bank was not doing a good enough job in ensuring that hacked pokemon do not get transferred to X and Y, Nintendo pulled it back, however those who downloaded pokemon bank when it was out can still use the feature and yes hacked pokemon have made their way to X and Y.

It is actually considered legal, there is a way to use the us walmart code for the HA chimchar to obtain the pokemon in other regions so lets have a look at other pokemon which were probably hacked.
